Terms of Service
These terms govern your use of DV4, the AI video service at dv4.ai, including the app and DV4 used from an AI assistant. You accept them when you create an account and confirm that you agree. If you do not agree, do not create an account or use DV4.
Who you are agreeing with
These terms are an agreement between you and Deep Variance Inc., a Delaware corporation ("Deep Variance", "we", "us"). If you use DV4 for an organization, you confirm you may accept these terms for it, and "you" includes that organisation. Contact: support@deepvariance.com.
What DV4 does
DV4 turns a written description into a finished video with sound. It plans the shots, films them with AI video models, and can add music, on-screen text and captions. On paid plans you can also give it your own pictures and soundtrack. It can also make motion graphics: animated text and shapes made as code by an AI model.
Videos, plans, music and text are produced by AI. They can differ from what you asked for, contain mistakes, or look or sound like something you did not intend. Check a video before you publish or rely on it.
Accounts
You must be at least 18, or the age of majority where you live, and give an accurate name and email address. Keep your password secure; you are responsible for activity under your account, including what an AI assistant you connect does with it. Tell us promptly if you believe your account has been compromised.
Plans and limits
Every account has a plan. The plan sets how many credits you get each month, how long each video can be, the highest quality, how many videos can run at once, and which features you get. Free includes 90 credits a month; Plus, Pro and Business include more, as shown on the pricing page. The month runs from the day you signed up to the same day the next month (UTC). Credits your plan includes that you have not used by the end of the month expire. Credits you buy (300 for $15, in Settings) never expire, and are used after your plan's. The app shows your plan and what you have used under Usage & limits.
A video costs credits for each second of video delivered, at a rate set by its model and resolution, and a picture costs 1 credit. When you start a video, whether in the app or from an AI assistant, we hold the most it can cost; when it is delivered we charge its delivered length and give back the rest. If it fails, is refused by our safety checks, could not start because a safety check could not run, or is cancelled, the held credits are given back. Deleting a delivered video gives no credits back. We may also limit how often you can make requests, to keep DV4 working for everyone, and may make a video wait when demand is high.
Payments
DV4 does not take payments yet. The pricing page shows the prices we plan to charge. Until payments open, we set paid plans on accounts ourselves, at no charge. Before we take any payment, we will add the payment terms here and ask you to accept them.
What you may not make
DV4 checks every request and every video against these rules, and refuses what breaks them. You agree not to use DV4 to make, or try to make:
- sexual or adult content of any kind, including nudity, sexualised poses, fetish content and "suggestive" requests, however they are framed;
- anything showing a minor in a sexual, suggestive, violent or exploitative way;
- real public figures, or identifiable private people without their consent, including through pictures of faces or recordings of voices you upload;
- graphic injury, torture or violence presented as something to admire;
- content that promotes or instructs self-harm;
- attacks on protected groups, or harassment of a person;
- instructions for weapons, drugs or crimes;
- copyrighted characters, logos or trademarks you have no right to use. DV4 may replace them with generic ones or refuse the request.
Repeated refusals suspend an account for a time. A refusal involving minors locks the account until a person reviews it, and we preserve evidence and report it as the law requires.
Other things you may not do
- upload pictures or sound that you have no right to use, or that show people who have not agreed;
- use DV4 to break the law, mislead people about who or what is real, or infringe anyone's rights;
- try to get around our safety checks, limits or security, or access another person's account or data;
- resell or provide DV4 to third parties as a service without our written permission;
- reverse engineer DV4 except to the extent the law allows despite this restriction;
- use DV4 in breach of US export control or sanctions laws. You confirm that you are not located in, or acting for anyone in, a country or region subject to comprehensive US sanctions, and that you are not on a US government restricted party list.
Your content and your videos
You keep all rights in your prompts and the pictures and sound you upload, and, as between you and us, in the videos made for you. You give us the limited permission needed to process them to provide DV4 to you, including sending them to our AI providers, and to improve DV4, as described in the Privacy Policy. You are responsible for how you use and publish your videos.
Finished videos are deleted 30 days after they are made. Download any video you want to keep.
Feedback is optional. If you send it, we may use it without obligation to you.
DV4 in AI assistants
You can connect DV4 to ChatGPT, Claude, Perplexity and coding agents. A connected assistant acts for you: the videos it starts count against your plan and follow these terms, the same as videos you start in the app. The assistant's own terms also apply to your use of it. You can disconnect DV4 in the assistant's settings at any time.
Our rights
Subject to these terms, we give you a limited, non-exclusive, non-transferable, non-sublicensable license to use DV4 while your account is active. DV4, its websites, software and content otherwise belong to Deep Variance or its licensors. Open-source components are licensed under their own licences, and nothing here limits your rights under them.
Suspension and termination
You can stop using DV4 at any time. We may suspend or close an account that breaks these terms or puts DV4, other users or other people at risk. Where reasonable, we will tell you first and give you a chance to fix the problem. We may discontinue DV4 or a plan with reasonable notice. Sections that by their nature should survive (your content, feedback, our rights, disclaimers, limitation of liability, indemnity, governing law and General) survive.
Disclaimers
Except as expressly stated in these terms, DV4 is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that DV4 will be uninterrupted or error-free, or that its videos will be accurate or match your request. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if advised of the possibility. Each party's total liability arising out of these terms is limited to the greater of the fees you paid us in the 12 months before the claim arose and one hundred US dollars.
These limits do not apply to your indemnity obligations, your breach of the "What you may not make" or "Other things you may not do" sections, or liability that cannot be limited by law, such as liability for fraud.
Indemnity
You will defend and indemnify Deep Variance against third-party claims arising from your prompts and uploads, the videos you publish, or your breach of these terms. The party seeking indemnity must give prompt notice and reasonable cooperation.
Changes to DV4 and these terms
We improve DV4 and may change or discontinue features. We may update these terms. For a material change, we will give at least 30 days notice on dv4.ai and by email to account holders, and ask you to accept the new version. Continuing to use DV4 after it takes effect means you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from these terms or DV4, and both parties consent to that jurisdiction. Nothing here removes rights you have under the mandatory consumer protection laws of the country you live in.
General
These terms are the whole agreement between you and us about DV4. Our Privacy Policy explains how we handle personal data and is not part of this agreement. If you have a separate signed agreement with us covering DV4, that agreement controls where it conflicts with these terms. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Neither party may assign these terms without the other's consent, except to a successor in a merger, acquisition or sale of all or most of the relevant business, with notice to the other party. Neither party is liable for delays caused by events beyond its reasonable control.
You agree that we may give you notices about your account and these terms electronically, by email to your account email or in the app, and that these satisfy any legal requirement that they be in writing.
